The Services are intended for business use only, specifically for licensed cannabis retailers and other businesses operating in the 21+ regulated cannabis industry. By using the Services, you represent and warrant that you are (a) at least 21 years old, (b) authorized to act on behalf of a licensed cannabis business, and (c) legally able to enter into a binding contract.

CULT Loyalty offers loyalty and membership program services for cannabis retailers, including program design and launch, program rebuilds, and monthly program management. Specific deliverables, timelines, and fees for engaged clients are set out in a separate written agreement or statement of work.

Any performance figures, ROI examples, case studies, or benchmarks displayed on this website — including but not limited to references to "11×" return, activation rates, member share of revenue, or any before/after numbers — are illustrative models based on industry benchmarks and hypothetical scenarios. They are provided for educational purposes only and are not a guarantee, warranty, or promise of any specific result. Actual results vary based on many factors outside our control, including market conditions, execution, staffing, product mix, pricing, and local regulation.

You agree not to:

• Use the Services in violation of any applicable law, regulation, or third-party right;
• Reverse engineer, scrape, or attempt to gain unauthorized access to the Services or their underlying systems;
• Introduce malware, disrupt the Services, or interfere with other users;
• Misrepresent your identity, affiliation, or licensing status;
• Use the Services to send unsolicited or unlawful communications.

The Services and all content on this website — including text, graphics, logos, marks, checklists, and program frameworks — are owned by or licensed to CULT Loyalty and are protected by intellectual property laws. Except for a limited, revocable, non-exclusive right to view the site for its intended purpose, no rights are granted to you.

The Services may contain links to third-party sites or resources. We are not responsible for the availability, content, or practices of those third parties, and links do not imply endorsement.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CULT LOYALTY OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), OR, WHERE A PAID ENGAGEMENT EXISTS, THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless CULT Loyalty from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising out of or relating to these Terms or the Services.

We may update these Terms from time to time. When we do, we will update the "Effective date" above. Continued use of the Services after changes constitutes acceptance of the updated Terms.
